Santa Monica Municipal Code:This has got to be BS..unlicensed cycling punishable by up 1k

Santa Monica, Ca has a new law that they are implementing that could put you a few bucks short of that new addition to your bike that you have been drooling over the past month or two. They also say that you can find yourself facing time "imprisonment in the County Jail for a period not exceeding six months, or by both such fine and imprisonment." I am still riding dirty though like always.

(a) Any person desiring to operate or use a bicycle upon any of the streets of the City shall apply therefor to the City Clerk or bicycle retailer (authorized agent) who shall record the name and address of the owner thereof and a description of said bicycle. The City Clerk or authorized agent shall issue the license requested upon payment by the applicant of the fee herein required. Said license when issued shall entitle the licensee to operate said bicycle for which said license has been issued upon all the streets, exclusive of the sidewalks thereof or elsewhere prohibited in the City.

(b) Any person violating this Section shall be guilty of an infraction, which shall be punishable by a fine not exceeding two hundred fifty dollars, or a misdemeanor, which shall be punishable by a fine not exceeding one thousand dollars per violation, or by imprisonment in the County Jail for a period not exceeding six months, or by both such fine and imprisonment. that’s freaky!  I’m going there on vacation, what happens if I rent a bike?  Does the rental place pay to register all their bikes?

The law is totally illegal according to California State Law.  The state law says that any city that makes people get a license for their bike can only require the “Residents” follow the law.  The Santa Monica law says that any “person” will be punished.  A guy from the Santa Monica City Council said that the law has been around since 1995 and that to date, there have been no arrests.  The only way that you’ll be “required” to get one is if you live in and buy a bike in Santa Monica.

California State Law
39002.  (a) A city or county, which adopts a bicycle licensing ordinance or resolution, may provide in the ordinance or resolution that no resident shall operate any bicycle, as specified in the ordinance, on any street, road, highway, or other public property within the jurisdiction of the city or county, as the case may be, unless the bicycle is licensed in accordance with this division.

Sounds as though cyclist are being singled out. If you already have a valid CA drivers license, are you not being forced to purchase another in order to use the same roads but on a specific non motorized vehicle?!?!? How bout runners register their shoes and while we are at it, let’s get anyone in a wheel chair licensed as well............. Any cyclist attorneys out there need a cause to champion and have the time to waste on it?
